AGREEMENT BETWEEN FAMILY &
ALPINE NANNIES & DOMESTICS, INC.
The undersigned parents (“you” or “your”), agree to engage Alpine Nannies & Domestics, Inc. (“Alpine Nannies”, “we” or “us”) as a referral service to locate and refer nanny or other household employee candidates to you.
THE PROCESS: We will interview you to determine your needs and preferences. Candidates who meet your criteria will be referred to you, after having been interviewed and having their references checked by us. All information obtained by us will be presented to you to permit you to interview the candidate and make a hiring decision. Since outstanding nannies and household employees are in great demand and get multiple offers quickly, you agree to contact the presented candidates within 24 hours of when they’re presented to you. You will notify us when you decide to hire one of them, at which point we will initiate a background search of the following: Criminal Records Search (through state records), Motor Vehicle Driving Records, and Social Security Number Verification. You understand that because of the comprehensive nature of this background check, it is done only after the offer is made, and therefore Alpine Nannies recommends that the individual not begin employment until the background search is completed and the results are reported to you. The final decision to hire the candidate is yours alone, as we cannot guarantee the accuracy or completeness of the report. You are encouraged to enter into a written employment agreement with any employee you hire. We will provide such a form to you and ask you to send a signed copy to us before the end of three weeks of employment. We make no representations or warrantees that the use of such form will ensure the agreed to performance expectations or employment conditions.
THE PLACEMENT FEE: A $200 non-refundable retainer is required to begin the placement process and is applied to the final fee. The final fee is due when the offer is accepted and the background check is completed. You agree to pay a placement fee of 10% of the live-out nanny’s first year’s annual compensation (gross annual salary and benefits). The fee is 12% for a housekeeper, chef, house manager, live-in nanny or other domestic help. All fees are based on a minimum of 15 hours/week except for a housekeeper which is based on 8 hours/week. We accept checks and MasterCard and Visa credit cards for payment. This agreement must include a credit card number and, for your convenience, the fee will be charged to your card if it has not been paid by the nanny’s first day of employment. By signing this agreement you specifically authorize Alpine Nannies to charge the fee to your credit card in this event. If the nanny or domestic help is hired and the placement fee is paid, the absence of a signed and returned agreement will still be considered an implicit contract. The placement fee is non-refundable.
90-DAY GUARANTEE: Our goal is 100% delight with the candidates we place. If for any reason you are unhappy with your employee, or she/he chooses to leave, within the first 90 days of employment, we will work with you to find a replacement at no additional charge. This guarantee applies if the placement referral fee was paid in full by the individual’s first day of employment and you have provided a copy of the signed employment agreement to us before the end of three weeks of employment by you. One replacement can be made during the initial 90-day period. If a second replacement is needed during the initial 90 days, or after the 90-day guarantee period, we will work with you to replace the person at 50% of the normal fee. This guarantee is valid for one year from the employee’s start date. For the replacement guarantee to apply, the job description, house, and employment agreement must remain the same.
LIABILITY & RELEASE: The nanny or household staff member that you hire is your employee, as we are a referral service, not an employer or independent contractor. You agree that you will be making an independent decision about the suitability of any candidate you interview or hire through us and that we shall have no responsibility for the acts of any individual we refer to you, whether intentional or unintentional, including, but not limited to, acts that result in damage to personal property, damage to auto, personal or psychological injury or even death. You also agree that you will defend and indemnify us against any claim made by a nanny or household staff member, or his/her representatives, heirs, successors and assigns, against you, your family, guests, heirs, successors and assigns, including but not limited to damage to personal property, damage to auto, personal or psychological injury or even death.
CONFIDENTIALITY: You agree that all candidate information presented by us will be kept confidential and that you will to not share this information with any third party who may then employ the candidate. In the event that you provide to a third party information about an individual we refer to you and that person is employed by that third party, then you agree that you will pay us a full fee for that individual.
